FOXTAIL PINES OWNERS ASSOCIATION (FPOA) FREQUENTLY ASKED QUESTIONS (FAQ) Question: I have just bought property in the Foxtail Pines community. Where can I get a copy of the covenants & by-laws? I did not receive one from my real estate agent. Answer: You should have received the covenants at the time of closing. However, you can download an electronic copy under documents on this site. The FPOA Board of Directors will present newly-typed covenant documents following the covenant review currently in progress. Question: I am planning on repainting my cabin. Do I need permission even if I am planning on using the same color? Answer: Yes. The Architectural Control Committee needs to ensure all projects conform to the covenants. The procedure is very easy. Just download the ACC application (under documents on this site.) You can email the completed application to our ACC Committee chair: _____________or mail to: FPOA, Attn: ACC, P.O. Box ____ Fairplay, CO. 80440 Question: I have recently purchased property and am planning to build next spring. What do I need to do conform to the covenants? Answer: You need to complete an ACC Application and building plans as soon as possible even if you have not yet received your building permit from Park County. This way we can help you avoid any conflicts with our covenants and/or Park County building regulations. We will review and approve the form (with changes if necessary) as soon as the building permit is received. Download the ACC application (under documents on this site.) The covenants require that the ACC respond to you within 30 days. Question: How much are Annual Dues and when are they due? Answer: The annual dues assessment is currently $100 per lot per year. You will be invoiced by the association in ______________, and dues are due and payable on receipt of the invoice. If the dues are not paid within 30 days after the due date, the assessment shall bear interest from the date of delinquency at the prescribed rate (currently 10% per year), a lien may be placed on your property. Question: Are horses allowed in Foxtail Pines? Answer: Yes, horses are allowed in the subdivision. (Details) Question: Is there fishing in the Foxtail Pines pond? Answer: Yes, the FPOA stocks the pond at the community picnic area. Fishing is for FPOA members and their guests only, and a fishing license is generally not required (especially if your catch is taken home and not removed from the subdivision). Individuals fishing at our pond may be asked for proof of FPOA membership. Guests must be accompanied by a member. We ask that all anglers respect our daily catch limit of two. Information on Colorado State Game, Fish and Parks regulations is available at www.xxxxxxxxxxx.co.st. Question: Are off-highway vehicles, including ATVs, dirt bikes and snowmobiles permitted? Answer: Yes, but only on your private property. Park County Regulations do not allow operation of off-highway vehicles on county maintained roads. Violators may be ticketed. Question: When is the annual Foxtail Pines Owners Association meeting held? Answer: The covenants provide that the annual meeting is held on the first Saturday in August, usually at the community picnic area. Members will receive advance notification of the date, time, and location of the annual meeting. Question: I am unable to attend the annual meeting and would like to vote by proxy. How can I do this? Answer: Proxy ballots are sent to each property owner along with the annual meeting notice. The ballots will include instructions for completing and returning them.
